1. Acceptance of Terms

By creating a ParX account, purchasing a membership, booking a session, or accessing the facility, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services. Users under 18 require a parent or guardian to accept these terms on their behalf.

2. Facility Access & Door Codes

ParX operates as an autonomous, unstaffed facility with 24/7 monitored access:

  • Access codes are issued per booking and are valid only for your reserved bay window
  • Codes are personal and may not be shared; admitting unregistered persons is prohibited
  • All guests must be added to your booking and sign a waiver before entry
  • Tailgating (entering behind another member without your own code) is prohibited
  • ParX may revoke access for violation of these terms or unsafe conduct

3. Waivers

All users must sign a digital liability waiver before their first session. For users under 18, a parent or legal guardian must sign. Guests must sign waivers before accessing the facility. Waivers are completed through our app or website and remain on file.

4. Memberships & Billing

  • Memberships (Fairway, Junior Par, Tour) bill monthly in advance to your payment method on file
  • Member discounts apply to off-peak hours only, per the published schedule
  • Junior Par memberships require a parent-linked account
  • You may cancel your membership at any time; cancellation takes effect at the end of the current billing period
  • ParX may change membership pricing with at least 30 days' notice

Hourly bay time (member and non-member) is billed at the rates published on the pricing page at the time of booking.

5. Bookings, Cancellations & Extensions

  • Sessions are booked through the ParX app, subject to bay availability
  • Bookings may be cancelled or rescheduled in the app up to 4 hours before the session start for a full refund or credit
  • Cancellations within 4 hours of the start time are non-refundable
  • No-shows are charged in full
  • Sessions may be extended in 30-minute increments from the app when the bay is available, charged at your original booking rate
  • Tour members may book up to 30 days in advance; other tiers per published booking windows

6. Facility Rules & Conduct

To keep an unstaffed facility safe and enjoyable for everyone, you agree to:

  • Use simulators and equipment only as intended and per posted instructions
  • Only hit golf balls provided or approved by ParX, from the designated hitting area
  • Leave your bay clean and end on time for the next member
  • No smoking, vaping, or illegal substances anywhere in the facility
  • Alcohol only where and as permitted by posted facility policy and NC law
  • No pets (service animals excepted)
  • Follow all safety signage and in-app instructions

7. Damage to Equipment & Facility

You are responsible for damage to simulators, screens, projectors, or the facility caused by misuse or negligence during your session, beyond normal wear and tear. Sessions are video monitored; damage will be assessed and charged to the payment method on file. Report any pre-existing damage through the app at the start of your session.

8. Assumption of Risk & Limitation of Liability

Golf, including simulator golf, involves inherent risks, including being struck by clubs or balls. You voluntarily assume these risks. To the maximum extent permitted by law, ParX and its owners, employees, and partners are not liable for indirect, incidental, or consequential damages arising from your use of the facility, and total liability is limited to the amounts you paid to ParX in the twelve months preceding the claim. Nothing in these terms limits liability that cannot be limited by law.

9. Monitoring & Security

The facility is monitored 24/7 by video surveillance for safety and security. Emergency support is available through the app at all times. Recordings are handled per our Privacy Policy.

10. Accounts & App Use

  • You are responsible for the accuracy of your account information and the security of your credentials
  • Accounts are personal and non-transferable
  • ParX may suspend accounts for suspected fraud, code sharing, or violation of these terms
  • 3Trak analytics and Virtual Clubhouse features are provided as-is and may evolve over time

11. School & Coach Programs

School partnerships and Independent Coach Program memberships are governed by separate written agreements covering rates, scheduling, rosters, and supervision requirements. Where those agreements are silent, these Terms of Service apply. Coaches are independent contractors, not employees or agents of ParX.

12. Changes to These Terms

We may update these terms periodically. Material changes will be communicated via email or app notification at least 14 days before taking effect. Continued use of ParX after changes take effect constitutes acceptance.
